Cabinet approves a Number of important Draft Laws and Decrees

The Council of Ministers met today, Wednesday, December 11, 2024, under the chairmanship of His Excellency Mr. Mohamed Ould Cheikh Ghazouani, President of the Republic.

The Council has studied and approved the following two draft laws:

– Draft law amending and repealing some provisions of Law No. 201-029 of July 30, 2013, containing the Merchant Marine Code.

The draft law proposes new provisions that eliminate the overlaps that may arise from the application of the powers of the real estate sector and the fisheries sector, in order to adapt the existing legal framework to adapt it to institutional developments that require the redefinition of the maritime public domain through:

– Amending the provisions of Article 20 of Law 2013-029, to include the coastline extending over one hundred meters within the powers of the sector in charge of real estate.

‐Draft law amending and repealing some provisions of Law No. 2024-003 of January 17, 2024 on Urbanism and Construction.

The current draft law introduces amendments to Law No. 2024-003 on Urbanism and Construction, with the aim of better defining responsibilities for the sectors concerned, as well as to improve the management of real estate, especially in major cities.

‐Urban documents, such as the Reclamation and Urbanization Master Plan (SDAU), the Local Urban Plan (PLU) and the Area Reclamation Plan (PAZ), are the prerogative of the urban sector. While the sector in charge of real estate is concerned with urban plans and grants.

‐As for the urban processes related to restructuring, urban aggregation, consultative reclamation and urban renewal, by virtue of their complexities and interventions, they are conducted in a participatory manner by the urban and real estate sectors.

The Council also examined and approved the following draft decrees:

‐Draft decree establishing bridges between indigenous education and formal education at the basic education level.

The draft decree aims to promote universal schooling and basic education in our country through the contribution of our original education at the primary and preparatory levels, to contribute to achieving equity in the field of schooling by benefiting from original education in areas where regular schools are not available, and to value the role played by indigenous education by building bridges that enable the investment of its gains in compulsory basic education and thus reducing the cost of compulsory schooling for regular schools.

‐Draft decree defining the powers and methods of functioning of the National Council for Donation and Organ Respect and determining its composition.

The current draft decree aims to implement the provisions of Article 23 of Law No. 2016-027 of July 29, 2016 on the donation, deduction and respect of human organs and tissues, through the establishment of a supervisory board called the National Council for Donation and Organ Respect, which is a coordinating and organizing body, and this draft decree defines the composition, organization and rules of operation of this council.

 

The Minister of Foreign Affairs, African Cooperation and Mauritanians Abroad made a statement on the international situation.

The Minister of the Interior, Promotion of Decentralization and Local Development made a statement on the situation at home.

The Minister of Social Action, Children and the Family and the Minister of Economy and Finance presented a joint statement concerning the National Strategy for Inclusion and the Promotion of the Rights of Persons with Disabilities.

This strategy aims to enable all persons with disabilities in Mauritania without any discrimination to enjoy all their fundamental rights and freedoms, and to participate in all aspects of life on the basis of equality with others.

‐ Develop the legislative and regulatory framework to ensure that all persons with disabilities enjoy all their rights and promote respect for their dignity.

‐ Promote an inclusive society and combat stereotypes and negative attitudes towards people with disabilities.

‐ Ensure the inclusion of persons with disabilities in all national policies, strategies and programmes.

‐ Ensure access to public services for persons with disabilities, and develop the necessary mechanisms and services for this.

Finally, the Board took some special measures.
