Supreme Court organizes the Second Scientific Forum for the Year 2024

The President of the Supreme Court, Cheikh Ahmed Ould Sid Ahmed, inaugurated, on Tuesday morning in the Great Hall of the Supreme Court in Nouakchott West, the second scientific forum on “The Supreme Court: Judge of annulment and judge of control over the compensation judiciary, manifestations of judicial treatment of disputes in the administrative matter”.

This forum, organized by the Supreme Court, aims to present and discuss the courts’ handling of administrative disputes at the level of the annulment judiciary and the compensation judiciary, and to reveal the shortcomings observed in the procedural texts and the difficulties on the subject of “Supreme Court / annulment judge and supervisory judge over compensation judge / aspects of judicial treatment of disputes in the administrative article” applied to the administrative judge in some cases published before him.

Judges from the Supreme Court and courts of appeal, government commissioners in administrative chambers, lawyers, representatives of some ministerial sectors, committees and specialized agencies will participate in the forum.

The President of the Supreme Court explained In his speech that this forum aims to open a scientific discussion on the best ways to correct and improve the quality of the judicial product in the administrative work by evaluating the handling of the annulment judge, represented by the Administrative Chamber of the Supreme Court, with the appeals submitted before him in the annulment lawsuit and requests to suspend its implementation, stressing the importance of discussing and evaluating the treatment of administrative chambers at the level of state and appeal courts of administrative liability lawsuits against the state and public law legal persons, and disputes related to administrative deals and contracts. Public works, and all administrative disputes not exclusively within the jurisdiction of the Administrative Chamber of the Supreme Court.

He added that the exploitation of the statistical data of the cases received by the Administrative Chamber of the Supreme Court at the level of the judiciary of annulment and compensation enabled to observe the increase in the number of lawsuits in the administrative work quantitatively, and the expansion of their scope qualitatively, and the complexity of the areas of some of them, especially those related to the individual status of employees and public agents, subscription competitions, access to public service, granting mining and mining licenses, licenses for telecommunications network operators, granting public procurements, bank accreditation licenses, and lawsuits against the state, indicating that there are problems related to this subject that require study and discussion from Before what are the procedural and legal controls that govern these cases under an institutional judicial system that adopts the principle of judicial unity, and the seriousness of the various actors in the administrative procedures dealing with the competent courts.

On behalf of the judicial family, he noted the great care given by His Excellency the President of the Republic, Mr. Mohamed Ould Cheikh El Ghazouani, President of the Supreme Judicial Council, to the development and modernization of our judicial system, which he embodied by chairing and sponsoring the public forums on justice that were organized from January 5 to 11, 2023.

The opening ceremony was attended by various Ministers :  Justice, the Public Service, the  Real Estate, State Property and Land Reform, the Delegate to the Economy and Finance in charge of the budget and other high ranked justice personnel : the Prosecutor General of the Supreme Court, the President of the National Bar Association, the Secretary General of the Supreme Court, and the Director General of the State Judicial Agency
